Estonian licence vs foreign licence: what it changes for you

In Estonia, only an operator licensed by EMTA may offer gambling. Under the Estonian Income Tax Act, gambling winnings are taxable income; only winnings from gambling organised under an Estonian operating licence or registration are tax-free. So the same win stays yours in full at an Estonian-licensed casino, while at a foreign-licensed casino income tax is deducted from it. For example, if you win €1,000 at a foreign-licensed casino and it is taxed at 22%, the income tax is €220 and you keep €780. The exact tax amount depends on your other income and your tax-free allowance; winnings from a foreign casino must be declared in your income tax return.

Am I breaking the law by playing at a foreign casino?

The penalty provisions of the Estonian Gambling Act target operators, service and payment service providers, and players under 21. For an adult player, the consequences of using a foreign casino are practical: the site may be blocked, payments may be stopped, income tax is due on winnings, and EMTA can't help in a dispute.
